1Acceptance of these terms

These Terms & Conditions ("Terms") are a binding agreement between you and Claritelo, a brand of The Nelson M Group LLC ("Claritelo," "we," "us"). They govern your use of claritelo.com and related services, including email and text-message programs (the "Services"). By using the Services or submitting a form, you agree to these Terms, our Privacy Policy, and, if you opt in to texts, our SMS Terms. Disagree with any part of them? Then please do not use the Services.

2What Claritelo is, and is not

Claritelo is an information service. We publish general, plain-language information about how clinical research works, how to read a study listing, what informed consent means, and which questions to ask a study team, and let visitors opt in to related updates. We do not give medical advice, diagnosis, or treatment, do not run, recruit for, or enroll people in clinical studies, and do not match or refer people to studies or research sites, and we will not share your details with study sponsors, research sites, recruiters, pharmaceutical or device companies, lead-generation companies, or any other partners.

• Decisions about your health and about taking part in any research are yours. Reading our content does not obligate you to do anything.
• Your doctor and the study team, not Claritelo, decide whether a study is right for you and explain its risks, procedures, and conditions.
• Every study is different. We do not guarantee that any study is safe, suitable, or open to you, or that you will qualify for or benefit from any research.

3Eligibility

You may use the Services only if you are 18 or over, are in the United States, and are able to agree to a binding contract. Information you submit must be about you, or about a person who has authorized you to submit it.

4Your information and accuracy

You are responsible for supplying accurate, current information and for updating it when it changes. Only a mobile number you own or are authorized to use may be provided. If your number changes or is reassigned, please reply STOP from the old number or contact us so that we do not message someone else.

5Communications and text-message consent

If you opt in, you agree that we may contact you by email and, if you check the applicable boxes, by automated text messages as outlined in the SMS Terms. Consent to texts is optional, is not a condition of purchase or of using the Services, and may be withdrawn at any time by replying STOP. Message frequency varies. Message and data rates may apply. 6Text messaging: rates, frequency, STOP and HELP

• STOP: Reply STOP to any message to opt out (STOPALL, UNSUBSCRIBE, CANCEL, END and QUIT also work). You will get one confirmation text and then no more messages.
• HELP: Reply HELP to any message for help, or contact us by email at [email protected] or by phone at 877-270-1781. Also, please message HELP to any of our numbers to receive help or information about the number.

Mobile information and opt-in data are not sold or shared with third parties or affiliates for marketing or promotional purposes. See the Privacy Policy and SMS Terms.

7Acceptable use

Prohibited conduct includes: (a) false, misleading, or third-party information; (b) unlawful, fraudulent, or abusive use; (c) interference with the Services or unauthorized access attempts; (d) bots or automated form submission; (e) copying, scraping, or reselling content without permission; and (f) impersonation. We can suspend or end your access if you engage in any of it.

8Third-party organizations and links

Organizations, programs, and products mentioned on or linked from the Services (for example government agencies, hospitals, or patient organizations) are run by third parties. We will not endorse any product, plan, or provider and are not responsible for the conduct, content, or results of third parties. Your relationship with any doctor or study team is between you and them.

9Intellectual property

The Services, including the Claritelo name, logo, text, graphics, and design, are the property of us or our licensors, protected under intellectual property laws. We license you, on a limited, revocable, non-exclusive, non-transferable basis, to view and use the Services for personal and non-commercial purposes only. Each photograph on the Site is used under its free-use license.

10Disclaimers

The services and all content are offered "as is" and "as available," with no warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We make no promise that the services will run without interruption or error, be secure, or that messages will arrive, or arrive on time.

Claritelo does not provide financial, legal, or tax advice, and makes no representation about any medical outcome, study result, or eligibility.

11Limitation of liability

Where the law permits, Claritelo and The Nelson M Group LLC, and their members, managers, officers, employees, and agents, will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, or goodwill, arising from or related to your use of (or inability to use) the services, or from any health or research decision you make or do not make. Our total liability for any claim relating to the services will not exceed one hundred U.S. dollars ($100).

In jurisdictions that do not allow certain limitations, those limitations may not apply to you. These Terms never limit liability that the law says cannot be limited.

12Indemnification

If your violation of these Terms, your misuse of the Services, or your submission of a phone number or other details you were not authorized to offer leads to claims, damages, or expenses (including reasonable attorneys' fees), you agree to indemnify and hold harmless The Nelson M Group LLC and its affiliates and personnel.

13Disputes, governing law, and arbitration

Informal resolution first. Before filing a claim, please reach out to us at [email protected] so that we have 30 days to try to resolve it.

Binding arbitration. Excluding small-claims matters and claims for injunctive relief for intellectual-property misuse, any dispute between you and Claritelo or The Nelson M Group LLC about these Terms or the Services is to be resolved by final and binding individual arbitration under the American Arbitration Association's Consumer Arbitration Rules. You may elect to hold it in your county of residence or by video or phone. The arbitrator may grant individual relief equal to what a court could, and judgment may be entered in any court of competent jurisdiction.

Class-action waiver. Where the law allows, you and Claritelo each agree that claims will be brought only individually, and not as a plaintiff or class member in a class, collective, or representative action.

Opt-out. You can opt out of arbitration within 30 days of your first acceptance of these Terms by emailing [email protected] using the subject line "Arbitration Opt-Out" and giving your name and mobile number.

Governing law. These Terms are governed by the laws of the state in which The Nelson M Group LLC has its principal place of business, without regard to conflict-of-law rules, and the Federal Arbitration Act. Subject to the arbitration clause, the state and federal courts located in that state have exclusive jurisdiction.

14Termination

You may stop using the Services at any time, and may opt out of messages by replying STOP. Violations of these Terms, among other things, may lead us to suspend or terminate access at our discretion. Sections which by their nature should survive termination (including disclaimers, limitation of liability, indemnification, and disputes) will.

15Changes

From time to time we may update these Terms and will post the update with a new "Last updated" date. By continuing to use the Services after the effective date you accept the updated Terms. Notice of material updates will be given where required by law.

16General

These Terms, together with the Privacy Policy and SMS Terms, are the entire agreement between you and us on this subject. If any part is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent, and we may assign them in connection with a merger or sale of the business.
